Ninth Circuit Denies Oregon's Petition for Rehearing or Rehearing En Banc

On December 15, the Ninth Circuit Court of Appeals denied the petition for rehearing or rehearing en banc filed by the state of Oregon on November 8 in Powell's v. Kroger. Oregon filed the petition after a Ninth Circuit panel ruled a statute that would have made illegal under any circumstances the distribution to minors of non-obscene sexually explicit materials.
