LETTERS AND MEMOS IN OPPOSITION: 2004

Rhode Island House Bill 7751 Substitute A
extends the definition of child pornography to include "a digital image, computer image or computer-generated image of a minor engaging in sexually explicit conduct."

New Jersey Assembly Bill 2029 would require Internet Service Providers to remove material identified by a user of their service as "defamatory or offensive."

Colorado House Bill 1078 would bar both the dissemination and access to minors of material that is "harmful to minors."

North Miami Ordinance.  This bill prohibits the sale or rental of any violent video game to a minor without the consent of his or her parent or guardian.

California Assembly Bills 1792 and 1793.  Governor Schwarzenegger signed a revised version of 1793 into effect in September 2004.  In initial drafts, Assembly Bill 1792 would have added video games with certain violent content to the definition of material that is "harmful to minors."  Assembly Bill 1793 would have required that games with certain ratings be inaccessible to certain minors.    The revised version was amended to require merely that video game retailers to post a rating system guide in their establishments.

Comment on FCC Notice of Inquiry.  The Media Coalition filed a comment with the Federal Communications Commission in response to its Notice of Inquiry on the matter of television programming with violent content and its impact on minors.  The comment reiterated The Media Coalition's position that restrictions on material containing violent content are unconstitutional.  The comment also questioned research that suggests a link between actual violence and media with violent content.  Several supporting documents addressing the social science were filed along with the comment.
